WV State Law (WV 22C-4-10) requires you to do one of the following with your solid waste:
- Subscribe to, use and pay for a solid waste collection service
- Have proof that your waste is disposed of monthly at a landfill
Failure to subscribe to garbage pickup or to show monthly landfill receipts is ILLEGAL. Violators are guilty of a misdemeanor and can be fined $1,000 and be required to complete community service.
What’s Illegal?
It’s illegal to burn solid waste (WV 22-5-6), bury solid waste (WV 22-15-10), dump solid waste (WV 22-15-10), dump solid waste in or near a stream or body of water (WV 20-7-28), dump solid waste into a roadside dump (WV 20-7-26) or create an open dump on your property (WV 22-15-10).
Solid Waste Definition
Solid Waste includes but is not limited to: newspaper, cans, bottles, garbage, trash, discarded household furniture, appliances, tires, carcasses of dead animals, cigarette butts, roof shingles, construction or demolition waste and other waste materials.
A Warning
Criminal Penalties for open dumping range from fines of $2,500 to $25,000 per day of violation and/or incarceration for up to one year.
